1 USA Swimming ATHLETE SELECTION PROCEDURES 2018 FINA Open Water Wrld Junir Champinships DEFINITIONS Available Swimmer. "Available Swimmer" means a swimmer wh (i) qualifies t be Selected t the Team in an Event accrding t these Selectin Prcedures and has cmplied with all eligibility requirements set frth in Sectins f these Selectin Prcedures; (ii) is between the ages 14 and 19 as f December 31, 2018; (iii) is eligible t cmpete in the divisin in which he r she qualified fr (please see sectin 1.3.1) (iii) certifies t USA Swimming that he/she remains available t swim thrugh the cmpletin f the 2018 FINA Open Water Wrld Junir Champinships; and (iv) indicates in writing that he r she will accept the invitatin t be Selected t the Team when that invitatin is ffered by USA Swimming and t swim in the Event fr which he/she qualifies in the 2018 FINA Open Water Wrld Junir Champinships (except as therwise prvided herein). If a swimmer des nt satisfy these requirements, then he/she is nt cnsidered an Available Swimmer. Champinships. Champinships refers t the 2018 FINA Open Water Wrld Junir Champinships. Event. Event refers t thse cmpetitin events cntested at the 2018 FINA Open Water Wrld Junir Champinships. Head Cach. Unless therwise indicated, "Head Cach" refers t the head cach f the Team. Natinal Team Open Water Directr. "Natinal Team Open Water Directr" refers t the USA Swimming Natinal Team Open Water Directr, r his/her designee. Natinal Team Managing Directr. Natinal Team Managing Directr refers t the USA Swimming Natinal Team Managing Directr, r his/her designee. Select/Selected/Selectin t the Team. "Select/Selected/Selectin the Team" refers t the Team selected by USA Swimming n May 6, 2018, plus any replacements that may be added t the Team pursuant t Sectin 4 f these Selectin Prcedures. 5K Qualifying Cmpetitin. "5K Qualifying Cmpetitin" means the 2018 USA Swimming Open Water 5K Junir Natinal Champinships, held Saturday, May 5, 2018 in Tempe, Arizna. 7.5K Qualifying Cmpetitin. 7.5K Qualifying Cmpetitin means the 2018 USA Swimming Open Water 7.5K Junir Natinal Champinship, held Sunday, May 6, 2018 in Tempe, Arizna. 1

2 10K Qualifying Cmpetitin. 10K Qualifying Cmpetitin means the 2018 USA Swimming Open Water 10K Natinal Champinships, held Friday, May 4, 2018 in Tempe, Arizna. Team. "Team" means the 2018 USA Swimming FINA Open Water Wrld Junir Champinship Team Selected May 6, 2018, plus any changes r replacements made pursuant t these Selectin Prcedures. Wrld Ranking. Wrld Ranking means the Wrld Ranking list printed frm the fina.rg website at apprximately 8:00 a.m. CDT n May 4, 2018 and cvering the perid f March 1, 2017 thrugh and including May 3, SELECTION SYSTEM 1.1. Prvide the minimum eligibility requirements fr an athlete t be cnsidered fr Selectin t the Team: In rder t be cnsidered fr Selectin t the Team, an athlete must, at the beginning f the applicable Qualifying Cmpetitin and at the time f Selectin t the Team: (a) (b) (c) be a registered athlete member f USA Swimming in gd standing; be a citizen f the United States; and be eligible t represent the United States in internatinal cmpetitin. In rder t be cnsidered fr Selectin t the Team, an athlete must, at the time f Selectin t the Team, be an Available Swimmer Natinality/Passprt requirements: Athlete must hld a valid U.S. passprt that will nt expire fr six mnths after the cnclusin f the Event Minimum Internatinal Federatin (IF) standards fr participatin: (a) All cmpetitrs selected t the Team must meet the eligibility requirements set frth by the Federatin Internatinale De Natatin (FINA). Fr additinal infrmatin regarding FINA s athlete eligibility please refer the FINA General Rules (GR 2) Other requirements (if any): (a) An athlete must qualify fr the Qualifying Cmpetitin, as described in Sectin 1.2, and cmpete in the Qualifying Cmpetitin; 2

3 (b) Each swimmer that has been Selected t the Team must sign and return t USA Swimming n May 7, 2018, and abide by, the USA Swimming applicable cmpetitin frms fr (c) Each swimmer that has been Selected t the Team must cmply with all applicable rules and requirements f FINA, USOC, IOC, FINA, WADA, USADA, and USA Swimming, including withut limitatin USA Swimming plicies and prtcls regarding Team preparatin and participatin, thrugh the Champinships. 1.2 Tryut Events: Prvide the event names, dates and lcatins f all trials, events and camps t be used as part f the selectin prcess: The Qualifying Cmpetitins Prvide event names, dates, lcatins and descriptin f hw athletes qualify fr the trials, events and camps listed abve in (if any): (a) T qualify fr a Qualifying Cmpetitin, an athlete must achieve an applicable Qualifying Cmpetitin time standard within 24 mnths f the entry deadline fr the Qualifying Cmpetitin. The Qualifying Cmpetitin time standards can be fund at: (b) Meet the qualificatin standards as utlined in the 2020 Dmestic Event Selectin Prcedures. This dcument can be fund at Cmprehensive Selectin Prcess: This Sectin 1.3 sets frth the steps by which Available Swimmers will be Selected fr t the Team. Althugh USA Swimming may annunce during the Qualifying Cmpetitins that swimmers have made the Team r qualified fr the Team, any such annuncement is infrmal and subject t change. The prcess f determining wh is eligible t be Selected t the Team will take place n r befre May 6, 2018, after cmpletin f the Qualifying Cmpetitins. The results frm the applicatin f these Selectin Prcedures will be annunced n May 8, 2018, althugh USA Swimming retains the right t make changes t the results t address withdrawals, vacancies and applicable FINA invitatins thrugh the entry deadline (time and date TBD) Team Size. The maximum allwable Team size is tw (2) men and tw (2) wmen in the fllwing Event and age categries: 5K Event: years ld as f December 31, K Event: years ld as f December 31, K Event: years ld as f December 31,

4 The actual Team size will be determined nce these Selectin Prcedures have been implemented. Fr purpses f these Selectin Prcedures, the men's and wmen's cmpnents f the Team will be cnsidered separately. USA Swimming is under n bligatin t Select t the Team a full team f 6 athletes in each, r either, gender Qualifying Cmpetitins. Perfrmances at the Qualifying Cmpetitins, frm amng thse eligible t cmpete in the Qualifying Cmpetitins as prvided in Sectin 1.2 abve, will be used t determine the Team. Perfrmances at the Qualifying Cmpetitins will be priritized using the pririty system described belw Vluntary Withdrawal. Any athlete may chse t vluntarily withdraw frm the Team. An athlete chsing t vluntarily withdraw frm, r cnsideratin fr the Team must d s in writing and is strngly encuraged t submit a written letter t the Natinal Team Open Water Directr and the Natinal Team Managing Directr by May 6, Applicatin f Pririties fr Team Selectin. Perfrmances in the Events at the Qualifying Cmpetitins will be priritized fr each gender as described in this Sectin These Pririties will be applied n r befre May 6, 2018, after cmpletin f the Qualifying Cmpetitins. Swimmers nt qualifying via ne f these pririties will nt be eligible t be Selected t the Team, unless they are subsequently added t the Team as a replacement accrding t the prcess set frth in Sectin 4. If, after applying the pririties set frth belw, as well as the prcedures set frth in Sectins and 1.3.6, there are fewer than six (6) men r six (6) wmen, r bth, n the Team, then USA Swimming will nt field a full Team, unless the Team is filled as a result f adding ne r mre replacements as prvided in Sectin Qualificatin fr the 5K Event The best tw finishing Available Swimmers frm the 5K Qualifying Cmpetitin will be Selected t the Team Qualificatin fr the 7.5K Event The best tw finishing Available Swimmers frm the 7.5K Qualifying Cmpetitin will be Selected t the Team Qualificatin t the 10K Event The best tw finishing Available Swimmers frm the 10K Qualifying Cmpetitin will be Selected t the Team Breaking a Tie. (a) Tie in Same Event. In the instance where there is a tie between tw swimmers in the same Event fr first place, bth swimmers will be Selected t the Team. In the instance where there is a tie between three r mre swimmers fr first place in the same Event r where there is a tie between tw r mre swimmers in the same Event fr secnd place, Wrld Rankings in the 1500 meter freestyle will be 4

5 used t break any ties If nly ne swimmer has a Wrld Ranking in the 1500 meter freestyle then that swimmer will be cnsidered the winner f the tiebreaker. (b) If this des nt break a tie, the tie will be brken by randm draw. Annuncement. Thse fficially Selected t the Team will be annunced n May 8, 2018, after cmpletin f the Qualifying Cmpetitins Selectin f Swimmers fr Events. (a) Swimmers selected t the Team as set frth in Sectin 1.3 will be selected t swim in the Event in which they qualified fr. (b) If there is a vacancy in an Event that arises n r after May 8, 2018, the replacement prcess set frth in Sectin 4 will be used t fill the vacancy in that Event. 2 DISCRETIONARY SELECTION 2.1 Prvide ratinale fr utilizing discretinary selectin (if any): All swimmers wh are Selected t the Team shall be eligible fr selectin t relays t be held at the Champinships cnsistent with the established age divisins. The Head Cach, in cnsultatin with the Natinal Team Open Water Directr and the assistant caches, shall select the swimmers fr each relay cnducted at the Champinships. In selecting the relay teams, the Head Cach shall cnsider all available relevant infrmatin, including but nt limited t each Team member's respective Qualifying Cmpetitin perfrmances, past relay perfrmances, Champinships perfrmances, persnal best perfrmances, Champinships Event schedules, individual wrklad, ther recent results and perfrmances, cnsistency f perfrmances, fatigue, health, fitness levels, training preparatin, scientific evaluatin, attitude and team chemistry. 3 REMOVAL OF ATHLETES 3.1 USA Swimming has jurisdictin ver ptential selectees. An athlete wh is t be Selected t the Team by USA Swimming may be remved as a selectee fr any f the fllwing reasns, as determined by the Natinal Team Open Water Directr and the Natinal Team Managing Directr: USA Swimming may remve an athlete wh has an injury r illness, as certified by the apprved Team physician, that is likely t keep him r her frm cmpeting at peak levels in the Champinships. If an athlete refuses verificatin f his/her illness r injury by the apprved Team physician assigned t the sprt f swimming (r his/her medical staff), his/her injury will be assumed t keep him r 5

6 her frm cmpeting at peak levels at the Champinships, and he/she may be remved An athlete may be remved if the Natinal Team Open Water Directr, in cnsultatin with the Head Caches, the Natinal Team Managing Directr, the USA Swimming Natinal Team Steering Cmmittee Chairpersn and the USA Swimming Athletes Vice Chair, determine that the swimmer is unable r unwilling t maintain a training regimen that is necessary fr peak perfrmance at the Champinships. (See Participatin and Cmmitment Agreement, which is included in Attachment B.) Any swimmer may be dismissed frm the Team at any time if the swimmer vilates any f the applicable FINA, IOC, USA Swimming r ther rules and regulatins applicable t the Team r its members, including withut limitatin applicable Cdes f Cnduct r Hnr Cdes If a swimmer is alleged t have cmmitted an anti-dping rule vilatin, that swimmer shall remain n the Team (r remain eligible t be Selected t the Team) until: (i) the swimmer is prvisinally suspended r declared ineligible after a hearing cnducted pursuant t the U.S. Anti-Dping Agency Prtcl r by FINA; (ii) the swimmer vluntarily accepts a prvisinal suspensin r sanctin f ineligibility; r (iii) the swimmer vluntarily withdraws frm the Team r relinquishes eligibility t be Selected t the Team. 3.2 An athlete wh is t be remved frm the Team r an Event r frm eligibility t be Selected t the Team, pursuant t these prvisins, has the right t a hearing per the USA Swimming Bylaws (usaswimming.rg), the USOC s Bylaws, Sectin 9, r the applicable anti-dping cde/prtcl befre such remval r declaratin f ineligibility. 4 REPLACEMENT OF ATHLETES 4.1 Describe the selectin and apprval prcess fr determining replacement athlete(s) shuld a vacancy ccur: The pl f ptential replacement athletes includes thse individuals wh meet the criteria set frth in this Sectin Adjustments t the Team and Events frm the time f Selectin t the Team (May 6, 2018) thrugh the entry deadline (Time TBD). (a) Filling Vacant Event Psitins with Team Vacancy. (i) Filling Vacant Event Psitins in All Events Fr all Events, if the Team is nt full (fewer than tw athletes in each Event as listed in Sectin 1.3.1) after a swimmer declines a psitin in an Event fr any reasn, r Event psitins therwise becme vacant, then 6

7 the vacancy in any such Event(s) shall be filled by the next fastest Available Swimmer in that Event. This prcess shall cntinue until tw (2) men and tw (2) wmen are selected t the Event Adjustments t the Team and Events after submissin f Entries by Name t the Organizing Cmmittee: (a) After USA Swimming submits the entries t the Organizing Cmmittee (Time TBD), USA Swimming will attempt t fill any vacancy with the next fastest Available Swimmer but there are n guarantees that USA Swimming will be successful in ding s. If the Organizing Cmmittee des nt accept the late entry then the Event entry will remain vacant. 5. SUPPORTING DOCUMENTS USA Swimming will retain the apprved Selectin Prcedures and all supprting dcuments, including scuting r evaluatin frms, etc., and data frm the selectin prcess fr six mnths. 6. PUBLICITY/DISTRIBUTION OF PROCEDURES The Selectin Prcedures (cmplete and unaltered) will be psted/published by USA Swimming n its website. 7. DATE OF SELECTION The Selectin f Athletes will take place n May 6, MANDATORY TRAINING AND/OR COMPETITION Specify the lcatin, schedule and duratin f mandatry training and/r cmpetitin: Event Date Site Depart U.S.A. September 1 Varius Airprts Training September 2-6 Eilat, Israel Cmpetitin September 7-9 Eilat, Israel Return Hme September 10 Eilat, Israel *Dates and lcatins are subject t change 9. ANTI-DOPING REQUIREMENTS Athletes must adhere t all IOC, WADA, FINA, USADA and USOC anti-dping prtcls, plicies and prcedures, as applicable. This includes participatin in Out-f-Cmpetitin Testing as required by the IOC, WADA, FINA, USADA and USOC Rules, as applicable. 7

8 10. USA SWIMMING BYLAWS AND GRIEVANCE PROCEDURES USA Swimming Bylaws and Grievance Prcedures can be fund at: usaswimming.rg 11. DISCLAIMER These prcedures are based n FINA rules and regulatins, as applicable and as presently knwn and understd. Any change in the Selectin Prcedures caused by a change in FINA rules and regulatins will be distributed t the affected athletes immediately. The Selectin Prcedures are based n the latest infrmatin available t USA Swimming. Hwever, the Selectin Prcedures are always subject t unfreseen, intervening circumstances, and realistically may nt have accunted fr every pssible cntingency. If any frce f nature, r frce majeure, shuld cause the altercatin r cancellatin f any f the selectin events listed in this dcument, these Selectin Prcedures will be revised. The terms and cnditins f these written Selectin Prcedures shall take pririty ver any verbal explanatin, clarificatin r interpretatin f the Selectin Prcedures, and an athlete relies n a verbal explanatin, clarificatin r interpretatin f these Selectin Prcedures at his r her sle risk. Any request r questin that wuld invlve a frmal clarificatin r interpretatin f these Selectin Prcedures, r that wuld address an issue nt therwise cvered in these Selectin Prcedures, shuld be submitted t the Natinal Team Open Water Prgram Directr at USA Swimming in writing by n later than April 1, 2018, and the respnse t such request by USA Swimming must be prvided in writing and, where apprpriate, must be published prmptly n the USA Swimming website. I hereby authrize USA Swimming t include the results f any drug testing f me in the published statistics fr drug testing and t include my name in the list f athletes wh have been drug tested, which USA Swimming publishes n their website. In the event I refuse t submit t a drug test r a drug test has a psitive result, r cmmit any ther anti-dping rule vilatin, I recgnize that I am subject t the adjudicatin prcesses established by USADA, WADA, and/r FINA, because f an anti-dping vilatin. Authrizatin and Event Prmtin I agree t be filmed and phtgraphed by the fficial phtgrapher(s) and netwrk(s) f USA Swimming. I hereby authrize the nn-cmmercial use f my name, picture, likeness, vice, and bigraphical infrmatin as filmed, videtaped and phtgraphed at the Event ( My Likeness ) by USA Swimming, in any and all nn-cmmercial media, related t (wned by) USA Swimming. The freging authrizatin specifically includes the use f My Likeness fr the nn-cmmercial purpse f advertising and prmting the Event prir t and during, the Event, but specifically excludes the use f My Likeness in cnnectin with the advertising r prmtin f any third party, rganizatin, prducts r services, including, withut limitatin, any Event spnsr (including, withut limitatin any USA Swimming spnsr), partner and/r exhibitr. In n event may USA Swimming use r authrize any cmmercial use f My Likeness. Any prpsed use f My Likeness shall be submitted t me fr my review and apprval prir t any such use. I understand and agree nt t use r authrize use f pictures f myself in the unifrms and equipment prvided by USA Swimming fr the purpse f trade, withut the cnsent f USA Swimming. Risk f Serius Injury I understand and appreciate that my participatin in the Event and in the sprt f swimming carries a risk f serius injury, including permanent paralysis r death, and a risk f serius illness, which culd be caused by water, fd r ther things in which I might cme in cntact r ingest. WAIVER & RELEASE In cnsideratin f allwing me t participate in this activity and the Event, I hereby release and hld harmless USA Swimming, members f its bard f directrs, and its fficers, emplyees, members, vlunteers, ther participants, and agents (cllectively, the Released Parties ), f and frm, and d discharge and waive, any and all claims, demands, lsses, damages, and liabilities that I may have r sustain with respect t any and all damage and/r injury, f any type, arising ut f my participatin in the Event. This release f liability shall include, withut limitatin, any claims fr negligence, grss negligence, willful miscnduct r breach f warranty that Participant may have against the Released Parties. Please d nt take this respnsibility lightly but rather embrace the rle yu have been given because f yur athletic abilities. The purpse f the Hnr Cde is t hnr the USA Swimming Natinal Team culture. It is imprtant fr all team members t understand that their actins in an internatinal setting reflect n their teammates, the sprt f swimming, and the United States. The culture f the USA Swimming Natinal Team sets us apart frm every ther swimming natin in the wrld and is an imprtant factr in ur success. As a member f the Team (the Event ) Dates fr which I am selected by USA Swimming t attend, I understand and will cmply with the fllwing guidelines as set frth by USA Swimming and the Natinal Team Athletes Cmmittee at all times during the Event. I understand in failing t cmply with these rules I may face disciplinary actins as described belw. Disciplinary actins will be evaluated by the tw head caches, elected team captains, the Natinal Team Managing Directr, r their designee. The final disciplinary actin will be decided by the Natinal Team Managing Directr. Any appeal fllwing any disciplinary actin shall be in accrdance with Part Fur f the USA Swimming Rulebk. Persnal Cnduct Rules: Prhibited actins by staff and athletes thrughut the duratin f the trip may result in immediate dismissal frm the team, lss f prize mney, bnus mney and/r mnthly stipend. Persnal cnduct vilatins put the status f athletes and/r staff in jepardy fr future natinal team r internatinal trips. Illegal U.S. r hst cuntry activity There will be n males in female rms, and n females in male rms The pssessin r use f alchl, tbacc prducts r nn-prescribed cntrlled substances Abuse and r distributin f any persnal prescribed medicatin Betting r gambling n swimming r influencing the utcmes and results f an event r cmpetitin Team members will refrain frm any behavir that wuld detract frm a psitive image f USA Swimming r be detrimental t its perfrmance bjectives. Team Rules: Team members, athletes, caches and staff, are expected t fllw the team rules belw and any additinal rules set during the cmpetitin. Failure t cmply with these rules may result in lss f prize mney, bnus mney, and/ r lss f mnthly stipend r cmmunity service requirements 12
